As the name suggests, a conjugal agreement is made before the marriage. In this kind of agreement, the couple will determine how they will share their fortune if the marriage ends. In that sense, it is a financial instrument. In drafting an agreement, it is important to recognize that there are two kinds of state laws that govern divorce – a fair distribution, practiced by 41 states, and co-ownership, which is practiced in some variants of 9 states. An agreement written in a state of Community property cannot be intended to govern what happens in a fair distribution state and vice versa. It may be necessary to retain lawyers in both states to cover the eventual case where the parties may be living in a state other than the one in which they were married. Often, people have more than one house in different states or they move a lot because of their work, so it is important to take this into account when developing. If entering a prenup is not something you can afford in terms of time or money before your wedding, you can absolutely arrange a post-uptial agreement after your wedding. A sunset arrangement can be inserted into a marriage agreement stipulating that the contract expires after a specified period. In Maine, it automatically expires after the birth of a child, provided the parties do not renew the contract if the parties do not renew the agreement.
 In other countries, a number of years of marriage will result in the expiration of a marriage. In countries that have adopted the Uniform Premarital Agreement Act (UPAA), there is no sunset provision in the law, but one could be under private contract. Note that the states have different versions of the UPAA. You will find these conditions in Article 1466 of Thailand`s Commercial and Civil Code. In accordance with Thai marriage laws, the matrimonial agreement focuses on the assets and financial consequences of marriage and sets the terms of ownership and management of common personal and concrete property and the eventual division of marital property when the marriage is dissolved. The marriage agreement also contains a list of each party`s personal property at the time of marriage and ensures that debts and property prior to marriage remain in the possession of the original owner or debtor. Personal property includes: In many cited countries, criminal history can also protect unshared property and money from bankruptcy and can be used to support lawsuits and transactions during marriage (e.g. B if a party has sold or unduly mortgaged property set aside by its partner). Marital agreements may restrict the ownership and support rights of the parties, but also guarantee the right of one of the parties to seek or obtain assistance up to a certain limit. It may be impossible to set aside a properly designed and executed prenup.
A prenup is able to dictate not only what happens when parties divorce, but also what happens when they die. You can act as a contract to make a will and/or remove any ownership rights over the property, estate, estate, right to predetermined inheritance and the right to act as executor and administrator of the spouse`s estate.  Similarly, these agreements also provide financial distributions in the event of the death of a spouse.
